WARRANTY POLICY

WARRANTY TERMS

The warranty is limited to functional defects of the gen-sets and light towers arising from defects in design, materials or assembly of the gen-sets, occurring within a period of twelve (12) months from the date of delivery or 1,000 running hours, whichever comes first.

The Seller’s responsibility under this warranty is limited to the supply of part(s) proven to be defective to the reasonable satisfaction of the Seller.

Transportation charges for returning such defective parts to the Seller shall be borne by the Buyer, and the shipment costs of the replacement parts back to the Buyer shall be borne by the Seller.

A gen-set, or any part thereof, which the Buyer or End User claims to be defective may be examined by the Seller and, where necessary, by TSI AGENCY LTD in order to determine whether the defect is covered under this warranty. The Buyer or End User shall provide all necessary pictures and any information requested by the Seller in order to understand and assess the defect and its cause.

THIS WARRANTY SHALL NOT APPLY TO THE FOLLOWING:

  1. Any operation or maintenance of the gen-set which is not in accordance with the TSI AGENCY LTD operation and maintenance manual.

  2. Any failure caused by contaminated fuels, oils, coolants/antifreeze, or by lack of proper fuels, oils or coolants/antifreeze (including any failure caused by the use of JP8 fuel).

  3. Gen-sets that are modified or altered in any manner not authorized in writing by TSI AGENCY LTD.

  4. Failures due to, but not limited to, normal wear and tear, accident, misuse, abuse, negligence, improper installation or improper sizing.

  5. Any incidental, consequential or indirect damages caused by defects in materials or workmanship, or any delay in the repair or replacement of defective part(s).

  6. Failures caused by any external cause or Act of God, including but not limited to collision, fire, theft, freezing, vandalism, riot or war, lightning, earthquake, windstorm, hail, volcanic eruption, water damage or flood, tornado, hurricane, terrorist acts or nuclear holocaust.
